Terms of Service

Welcome to Sports Fountain. These Terms of Service (“Terms”) govern your access to and use of the Sports Fountain website, content, Fan Zone, and any related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

  1. Acceptance of Terms

By accessing Sports Fountain, you agree to comply with these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you may not use our Services.

Our Privacy Policy describes how we collect, use, and share information about you, and it is incorporated into these Terms by reference. Please read it alongside this document.

  1. User Accounts and The Fan Zone

To access certain features, such as commenting or the Fan Zone, you may be required to register for an account.

Age Requirement: You must be at least 13 years of age to register for an account or use the interactive features of the Services.

Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials. If you sign up through a third-party service such as Google, you are also subject to that provider’s terms. You are responsible for all activity that occurs under your account and agree to notify us promptly of any unauthorized use.

Community Guidelines: Your use of the Fan Zone and comment sections is subject to our Community Guidelines. We reserve the right to remove content and to suspend or terminate accounts that engage in harassment, spam, hate speech, or other disruptive behavior.

  1. User-Generated Content

When you post comments, submit Fan Zone topics, or share material on Sports Fountain (“User Content”), you retain ownership of your content. By posting, you grant Sports Fountain a worldwide, non-exclusive, fully paid, royalty-free license to display, use, reproduce, modify, distribute, and create derivative works of that content in connection with operating and promoting the Services.

You may delete your User Content at any time. Deletion ends the license going forward, except for copies already distributed, cached, or shared by others, and except where we are required to retain the content by law.

You represent and warrant that you have the right to post your User Content and that it does not violate the intellectual property or privacy rights of any third party.

  1. Intellectual Property

All original content published by Sports Fountain, including articles, editorial analysis, custom graphics, and site design, is our property and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or commercially exploit our original content without explicit written permission.

Except as expressly permitted by applicable law or authorized by us in writing, you will not, and will not permit anyone else to: (a) use any automated tool, including robots, spiders, crawlers, or scrapers, to access, store, copy, modify, distribute, or resell any content on the Services; (b) use our content for text and data mining or for training, fine-tuning, or grounding any machine learning or artificial intelligence system; (c) circumvent or disable any security features of the Services; or (d) compile or collect our original content as part of a database or other work.

  1. Third-Party Links and Content

Our Services may contain links to third-party websites, advertisements, or services that are not owned or controlled by Sports Fountain. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party website.

  1. Advertising

The Services are supported by advertising. By using the Services, you agree that we may display advertising and sponsored content, including banner ads, video ads, and native ads. Our advertising partners may use cookies and similar technologies as described in our Privacy Policy.

Email marketing is separate. We send newsletters and promotional email only to subscribers who have signed up for them, and every email includes an unsubscribe link.

  1. No Betting or Professional Advice

Any odds, projections, predictions, or opinions published on Sports Fountain are provided for informational and entertainment purposes only. Nothing on the Services is betting advice, financial advice, or a recommendation to place any wager. Gambling laws vary by jurisdiction and you are solely responsible for complying with the laws that apply to you. If you or someone you know has a gambling problem, help is available through the National Problem Gambling Helpline at 1-800-522-4700.

  1. DMCA / Copyright Infringement

If you believe your copyrighted work has been posted on the Fan Zone or anywhere else on our Services without authorization, contact our designated agent at editorial@sportsfountain.com. Your notice must include: (i) an electronic or physical signature of the copyright owner or authorized agent; (ii) a description of the copyrighted work; (iii) the URL where the infringing material is located; (iv) your contact information; (v) a statement of good faith belief that the use is unauthorized; and (vi) a statement made under penalty of perjury that the information is accurate.

Counter-Notification: If your content was removed and you believe the removal was a mistake or a misidentification, you may send a counter-notification to the same address, including your signature, identification of the removed material and its previous location, a statement under penalty of perjury that you believe the removal resulted from mistake or misidentification, and your consent to the jurisdiction of the appropriate court.

Repeat Infringers: We terminate the accounts of repeat infringers in appropriate circumstances.

  1. Indemnification

You agree to indemnify, defend, and hold harmless Sports Fountain, its affiliates, writers, officers, and agents from any claims, damages, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising out of your use of the Services, your User Content, your violation of these Terms, or your violation of any rights of a third party.

  1. Disclaimer of Warranties

Sports Fountain provides its Services on an “AS IS” and “AS AVAILABLE” basis. While we work to deliver timely, accurate, and high-quality sports journalism, we make no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or completeness of the content. Your use of the platform is at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

  1. Limitation of Liability

To the fullest extent permitted by law, Sports Fountain, its writers, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations, so they may not apply to you.

  1. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Services or other users. We may also modify or discontinue any part of the Services at any time. Sections 3, 4, 9, 10, and 11 survive termination.

  1. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver of it. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them. These Terms, together with our Privacy Policy and Community Guidelines, are the entire agreement between you and Sports Fountain regarding the Services.

  1. Changes to These Terms

We may modify or replace these Terms at any time. We will provide notice of significant changes by updating the “Last Updated” date at the top of this page. Your continued use of the platform after changes take effect constitutes acceptance of the new Terms.
